Terms of Service

I want to ensure the business side of the process is transparent and easy to understand so we can concentrate on what’s important … that is making great photo’s.

However, for full disclosure please take a moment to read the Terms of Service below … they’re important because they protect both of us under Australian Copyright and Contract Law.

The following is a non-exhaustive list of Terms of Service in alphabetical order:

Acceptance of quote: Acceptance of any quote offered by Leanne Hardy Photography signals you have read and agree to Terms of Service listed on this page and agree to mutual contractual obligations as stated on the quote and covered under Australian Law.

Booking dates: Session dates are not locked in until your non-refundable booking fee is paid.

Cancellation of booking: Once your session date is confirmed it is reserved solely for you. If you cancel with short notice, and don’t rebook, I may not have another client on a wait list for that date.

Private bookings - the non-refundable booking fee of $100.00 is forfeited if booking is cancelled with less than 72 hours notice.

Commercial bookings - 20% of the value of your quote will be invoiced as a booking fee and will be due and payable in the event you cancel your booking with less than 14 days prior notice.

Commercial clients licensing: Unless otherwise agreed, commercial license for use period is 12 months for print and digital media.

Consultation: We consult together to come up with a plan for your session. At this time we’ll confirm your requirements, aesthetic preferences, pricing, exchange necessary details and arrange payment of any non-refundable booking fee to secure your booking.

Where copyright is assigned in writing or under Australian Copyright law conventions to another party Leanne Hardy Photography retains an exclusive license for the right of reproduction, publication and communication for the work. Images on this website are presented as All Rights Reserved and cannot be copied or reproduced in any form without express written consent of Leanne Hardy Photographer.

Delivery of images: High resolution, professionally edited photos will be supplied via Dropbox or USB. Photos cannot be released until balance is paid in full. Payment can be made by Direct Debit or face-to-face via Credit Card/Eftpos* using Square app. *Note: payments made using Square app will attract a 1.9% surcharge.

Exclusive license & Use of Photos: Unless otherwise agreed, the Client gives Leanne Hardy Photography exclusive license and consent to display the photographs taken by Leanne Hardy as exemplars and for entrance into photographic competitions and release all claims to profits that may arise from use of images. 

Unless otherwise agreed, the Client hereby grants to Leanne Hardy Photography exclusive license and the right to use and publish photographs of the Client or in which the Client may be included for editorial, trade, advertising and any other promotional purposes in any manner and medium; to alter the same without restriction and to copyright the same.

Extreme weather events … we do live in the tropics … in the event we must reschedule due to severe weather events your booking fee is not forfeited and we will reschedule a new, mutually convenient date, as soon as possible.

Limit of liability: In the unlikely event that the Leanne Hardy Photography is injured or becomes too ill to photograph the event Leanne Hardy Photographics will make every effort to secure a replacement photographer. If a situation occurs where a suitable replacement is not secured, responsibility and liability is limited to the return of all payments received for the event. Furthermore, in the unlikely event that photographs have been lost, stolen or destroyed for reasons within or beyond Leanne Hardy Photographics control, Leanne Hardy Photography is limited to the return of all payments received for the event. The limit of liability for a partial loss of originals will be a pro-rata amount of the exposures lost based on a percentage of the total number of originals.

Moral Rights: As defined under Australian Copyright Law Moral Rights, including the Right of Attribution, are retained by the photographer at all times. As such the photographer retains the right to be credited when photographs created by Leanne Hardy are reproduced in any medium, including social media.

Payment Methods: Payment can be made by Direct Debit or face-to-face via Credit Card/Eftpos* using Square app. *Note: payments made using Square app will attract a 1.9% surcharge.

Travel: rates include locations in Cairns area, that is between Ellis Beach to Gordonvale. Areas outside of Cairns immediate area will incur a travel fee as agreed.
